Agreement
for SEED

Publisher KLANG GAMES GMBH
Last Updated: September 16, 2025
Before you and your seedlings can start, we want to make you aware of the following Agreement. We know they are dry and tough, but it is important that we as a community abide by these rules.
All set? Then we're ready to get started.
These Agreement (also the “Terms”) and the applicable policies referenced herein and listed in Annex 1 to these Terms (the “Applicable Policies” and, together with the Terms, the “Agreement”) govern access to and use a massively multiplayer online computer game called SEED (“SEED” or the “Game”), developed and published by Klang Games GmbH, Adalbertstraße 5, 10999 Berlin, (“Publisher”, the “Publisher”, “we”, “us”, “our”) via a website providing access and the capacity to register a user account (the “SEED Community Portal” and the SEED game client (the “SEED Launcher”).
Publisher keeps the Agreement available in its then current form on the SEED Community Portal, accessible via https://seed.game. Please ensure to always keep a copy of the Agreement, as access to versions that are no longer applicable may be restricted.
By signing up for your user account for SEED (the “Cultivator Profile”), you (“Player”, “User”, “Cultivator”, “you”, “your”) agree to be bound by this Agreement in each case, as amended from time to time.
If you do not agree to and/or do not comply with the Agreement, you may not access or use SEED or your Cultivator Profile. Non-compliance with any provision of the Agreement may lead to the restriction, the immediate and permanent ban and/or the permanent deletion of your Cultivator Profile.
Any terms and conditions provided by you shall not apply, unless agreed separately in writing and duly signed by an authorized representative of Publisher.
Eligibility and Access
SEED is available exclusively to individuals aged 16 years or older due to mature content (violence, alcohol use, sexuality). By accessing SEED, you represent that you meet this age requirement; if your jurisdiction requires a higher age of majority, you must comply with that threshold.
Access to SEED is strictly prohibited in jurisdictions subject to comprehensive sanctions administered by the U.S. Office of Foreign Assets Control (OFAC), including but not limited to Cuba, Iran, North Korea, Syria, the Crimea, Donetsk, Luhansk, Kherson & Zaporizhzhia Regions of Ukraine, and any other region as updated by OFAC from time to time. You represent that you are not located in any such jurisdiction nor are you a person or entity listed on any OFAC list of prohibited parties.
Access to SEED is provided subject to the SEED Access & Content Policy, provided as Annex 2 to these Terms. Before making any purchase in the SEED Store or playing SEED, you confirm that you agree with the SEED Access & Content Policy.
The availability of the Community Portal, the SEED Launcher, and SEED are subject to you maintaining a Cultivator Profile strictly in compliance with this Agreement. Players may terminate their account at any time via written notice to Publisher, which can be raised via the “Support” button on the Community Portal. Publisher will delete accounts within 14 days of such request. Publisher may deactivate or permanently ban accounts in case of non-compliance with the Agreement, or at its discretion to reasonably prevent any potential harm to Publisher or other Players; where possible, reactivation may be permitted upon reasonable request, subject to Publisher’s discretion.
Publisher reserves the right to irrevocably deactivate a Cultivator Profile at any time. In this case, this Agreement will remain in force, and you have the right to terminate the Agreement at any time. At your request, we will re-activate your account in our reasonable discretion.
Game State: Closed Beta
SEED is currently offered as a “Closed Beta” version; all features, mechanics, access rights and content are still in an experimental state and subject to change at Publisher’s sole discretion without prior notice.
You acknowledge that the Game may contain critical errors or flaws that may substantially impact gameplay experience. You may lose access to content, Virtual Assets or your progression, without warning or notice, due to, for example, but not limited to malfunctions of Game Systems or indirectly via exploits by other Players.
All prices and access mechanisms reflect this experimental state and are in due consideration of these potential risks, which you expressly acknowledge and accept prior to making any purchase via the SEED Community Portal and/or playing SEED.
You acknowledge that any prices charged for access to SEED are strictly in consideration of receiving early access to SEED in its current experimental state, not a fully polished game.
Accessibility and Warranties
Publishers sole and exclusive obligation vis-à-vis the Player is to provide access to SEED, subject to you controlling the relevant access rights via certain Virtual Assets in your Cultivator Account, as set out in the SEED Access & Content Policy and in accordance with this Agreement and applicable laws and regulations that Publisher or Player may be subject to. Publisher expressly does not warrant (i) the conformity of the game with any trailers or other materials published to showcase the vision of SEED on the Publisher website, in social media, or other platforms or media; (ii) the conformity of the game for the purpose of the Player’s intention or ambition; (iii) the consistent functioning and balancing of SEED’s Game Systems.
In case of the prolonged non-accessibility of SEED in its entirety for more than 7 consecutive days, meaning the Player is not able to access SEED without fault on their part, Publisher will, at its sole discretion, remedy the defect by either (i) refunding Player any purchase price paid in consideration of receiving access to SEED or (ii) reimburse Player with Virtual Assets allowing access to SEED in a capacity mitigating the non-accessibility due to an outage. These shall be Player’s sole and exclusive remedies in case of the described non-availability of SEED.
Purchases, Refunds & Outages
Players purchase access to SEED according to the SEED Access & Content Policy.
Refunds will only be granted if a Player is unable to access SEED for more than 7 consecutive days due to an outage or critical error attributable solely to Publisher’s systems or services, except where statutory law provides for a shorter period.
Refunds may be provided at Publisher’s discretion either as a monetary refund or as additional virtual items (e.g., Pollen or Seedlings).
No refunds will be granted for outages/errors caused by factors outside Publisher’s control, or for loss of access due to Player’s non-compliance with this Agreement.
Virtual Assets
All Virtual Assets and access rights in SEED are licensed to Players, not owned. Licenses are strictly limited, non-exclusive, non-transferable except as permitted within game mechanics/features, not sublicensable and revocable in accordance with this Agreement.
Trading and exchange of Virtual Assets outside designated features of SEED is strictly prohibited and constitutes a material breach of this Agreement.
Licenses can be revoked by Publisher at any time without notice, refund or compensation. The Publisher retains full control over asset management including revaluation and/or modification.

In the event of serious personal attacks, insults, defamation and threats, we reserve the right to involve law enforcement authorities.
When choosing the sanction to be imposed, we will consider the interests of the User concerned and, among other things, whether there has been any misconduct through no fault of our own or whether the infringement has been committed culpably. Virtual Assets
Subject to the SEED Access & Content Policy, SEED contains Virtual Assets, which may possess certain in-game value through their function as in-game currency, or non-fungible asset (such as virtual land). Virtual Assets each constitute a limited license permission to use features of Games and may be made available as part of the gameplay at Publisher’s sole discretion. Virtual Assets are not redeemable for monetary value from Publisher.
Each Virtual Asset that you acquire constitutes a limited license granted to you by Publisher to access and use certain in-game content, applications, services, and various user-created features in Games, and can be traded and/or transferred in Games with other users (and/or Publisher) in exchange for permission to access and use specific content, applications, services, and various user-created features. Virtual Assets may not be sublicensed, encumbered, conveyed or made subject to any right of survivorship or other disposition by operation of law or otherwise, and you agree that any attempted disposition in violation of this Agreement is null and void. Publisher may revoke any Virtual Asset(s) at any time without notice, refund or compensation.
You acknowledge that Virtual Assets are not currency or any type of currency substitute, financial instrument or asset, and are not redeemable for any sum of money from Publisher at any time. You agree that Publisher has the right to manage, regulate, control, and/or modify the license rights underlying such Virtual Assets as it sees fit, and may revalue or make such license rights more or less common, valuable, effective, or functional, and that Publisher will have no liability to you based on its exercise of this right. Publisher makes no guarantee as to the nature, quality or value of the features of Games that will be accessible through the use of Virtual Assets, or the availability or supply of such Virtual Assets.
Publisher may offer an exchange functionality as part of SEED through which Publisher may permit Virtual Assets to be traded by a user or exchanged by a user with another user or with Publisher.
You acknowledge that such exchange is created solely to enhance your experience while using Games, and that the terms "Buy" and "Sell" may be used to indicate the transfer of content licenses represented by Virtual Assets. You acknowledge that Publisher may deny, halt, suspend, discontinue, or reverse any order or subsequent transaction at any time in its sole discretion.
Virtual Assets may not be purchased or sold outside of such exchange functionality (if any). Any purchase or sale of Virtual Assets through any means other than the in-game exchange functionality is not permitted and is considered a violation of this Agreement which may result in suspension or termination of your user account.
Amendment to this Agreement
Publisher may amend this Agreement from time to time and will notify you of any changes by e-mail to the e-mail address associated with you. Publisher will request your consent to the amendments in case of significant changes, which affect the contractual relationship. Insignificant amendments (e.g. amendment required due to changes in law or case law relating to the protection of minors, health protection, tax law etc. or that are necessary to correct contractual imbalances in the relationship between you and Publisher insofar as this is arising after the initial conclusion of the user agreement or for the purpose of adapting to changed legal or technical requirements) shall become part of the agreement unless you object to such amendment in writing or text form within four (4) weeks of receipt of the notification of amendment.
In case you object to the amendments of the Agreement or deny your consent to the significant amendment, we reserve the right to terminate the agreement. We will inform you separately of the significance of this four-week period in the email containing the amended Agreement. However, this only applies if you use our services and are registered on the SEED Community Portal at the time the Agreement are changed.
Severability
Should any provision of this Agreement be or become void or ineffective in whole or in part, this shall not affect the effectiveness of the remaining provisions. Any provisions of this Agreement that are not included or are invalid shall be replaced by statutory law.
Governing Law and Jurisdiction
German law applies exclusively to the agreement between Publisher and the User including this Agreement. In the case of consumers, this choice of law shall only apply insofar as this choice of law does not deprive the User of the protections of consumer protection laws where the User has their habitual residence.
The European Commission provides the Platform for online dispute resolution under the following link: https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in alternative dispute resolution before a consumer conflict tribunal.

Annex 1 SEED Access & Content Policy
Cultivators can purchase various virtual access services from the Publisher, each of which constitute limited use rights to the content and gameplay experience of SEED in various scope and capacity. Below is a description of how such access is provided and the different types of access rights which may be offered for purchase by Publisher. Access services may be offered for purchase individually or as part of a bundle. The below list serves as a description only and does neither constitute a binding offer to purchase any of the described use rights nor imply that they may be available for purchase.
Name | Description |
Access to SEED | |
Cultivator | Cultivator is the name given to Players in SEED. |
Cultivator Profile | The Cultivator Profile is the user account of the Player, through which the Player can (i) interact with the SEED Store to purchase limited use rights granting access to SEED’s content, gameplay experience and features; (ii) subject to the acquisition of such use rights by purchase or voucher, access SEED in the applicable capacity and scope, for example by managing a Seedling; (iii) access SEED’s in-game chat; (iv) control Player owned Virtual Assets, such as Pollen or Special Items, subject to the Terms. The Cultivator Profile must adhere to the Community Standards. |
Avesta | Avesta is the virtual planet that hosts the life simulation gameplay experience of SEED. |
Game Systems | Game Systems are the core systems that orchestrate the life simulation on Avesta and collectively provide the gameplay experience of SEED. They may be exposed to the Cultivator in a way that either means they are (i) directly controlled by a Cultivator or a group of Cultivators; (ii) influenced and impacted by the Cultivator’s actions or omissions; (iii) function in the background; or (iv) any variation or combination of the previous. All Game Systems are in an experimental state and may be undergoing rapid changes, malfunctions or outages. Publisher may need to react without notice to patch malfunctions or mitigate the effects of a potential exploit. |
Virtual Society | A Virtual Society is formed by a group of Cultivators deploying their Seedlings within a specific virtual area and agreeing to a specific set of rules for their Seedlings. Virtual Societies may be locked or open. |
Virtual Assets | Virtual Assets refers to the entirety of Player controlled, embodied access services granting a Player limited access to SEED’s content. Virtual Assets can be acquired through (i) gameplay; (ii) purchase from Publisher (e.g. a Seedling); (iii) purchase from another Player’s Seedling in Avesta. They can be controlled by (i) directly by Players in the Cultivator Profile, or (ii) indirectly by Players, belonging to a Seedling controlled by a Player. Virtual Assets are limited use rights to SEED’s content provided at Publisher’s discretion and may be removed individually, or in their entirety, at any time, without reason. Where possible, Publisher will provide reasonable advance notice of the removal of or change to a Virtual Asset. In case of removal of a Virtual Assets purchased by a Player from Publisher, Publisher will reasonably compensate Player for the loss of the Virtual Asset, taking into consideration the interest of the Player, provided however, that Publisher shall under no circumstances be liable to compensate Player more than the original purchase price paid by Player to Publisher for the Virtual Asset. Publisher may, at its discretion, elect to compensate Player by providing a new Virtual Asset of similar quality, scope and value. |
Seedcoin | Seedcoin is a virtual currency enabling virtual commerce on Avesta. It is used and owned by Seedlings, not by Cultivators. Cultivators indirectly control Seedcoin by managing their Seedlings. Seedcoin is intended for exclusive use on Avesta and strictly limited to use within specifically designed game features. Seedcoin does not hold any real world value and cannot be redeemed for real world value. It is strictly prohibited to use Seedcoin outside of SEED’s specifically designed game features. |
Virtual Land | Virtual Land are parts of Avesta that may be controlled by a Cultivator indirectly through the control of their Seedling. |
Voucher | A Voucher is an invite code for SEED that grants a Cultivator specific access rights free of charge, courtesy of Publisher. They are distributed to selected Cultivators by the Publisher. Vouchers expire within fixed and set periods. Vouchers cannot be enforced and the delivery of any content or access right under a Voucher is strictly at the sole discretion of the Publisher. |
Limited Use Rights offered for Purchase in the SEED Store | |
Seedling | A Seedling is a simulated, virtual avatar that can be deployed by the Cultivator to live on the planet of Avesta. Cultivators manage Seedlings, but do not roleplay them under full direct control. Seedlings have a finite lifespan. A healthy Seedling will live for an average of 90 Seedling years, corresponding to 90 real world days. However, many factors can impact a Seedling’s life and a lifespan of 90 Seedling years is not guaranteed. Seedlings have partial autonomy and agency and in-game assets constructed by Seedlings with the support of the Cultivator belong to the Seedling. To maintain control of these assets, a Cultivator must control at least one Seedling. Seedlings may be (i) spawned from the space station Dezima, arriving on Avesta in a pod, as a young, adult Seedling, or (ii) raised by Cultivators as offspring of two Seedlings. All Seedlings allow Cultivators to access SEED and control in-game assets belonging to their Seedlings, but Seedlings spawned directly from Dezima are already shaped in their traits and characteristics, making the bond between Cultivator and Podster less personalized and the experience of SEED more generic compared to a Seedling that was raised as offspring. |
Pollen Pill | A Pollen Pill functions as a reverse contraceptive and allows two Seedlings to procreate and have offspring. |
Seedling Slots | A Seedling Slot allows a Cultivator to raise a Seedling’s offspring. |
Special Items | Special items are special Virtual Assets of purely cosmetic value with no other in-game utility, which can be owned by the Cultivator in the Cultivator profile. |
Pollen | Pollen is a virtual currency for sole and exclusive use in the SEED Store vis-à-vis Publisher and within specifically designed game features. Pollen does not hold any real world value and cannot be redeemed for real world value. It is strictly prohibited to use Pollen outside of SEED’s specifically designed game features. |
Gift Code | Gift Codes allow Cultivators to gift access to Virtual Assets to each other, subject to certain limitations and qualifications applying to Gift Codes. Gift Codes expire within fixed and set periods. Gift Codes become activated upon purchase by the Cultivator, not upon redemption in the SEED Store. If they are not redeemed by an applicable Cultivator (which cannot be the purchaser), they expire within the designated period. |
Gifted Seedling | A gifted Seedling is a single Seedling that can be redeemed by an account via a Gift Code that is not the original purchaser's account (you cannot gift yourself a Seedling). |
Society Kernel | A Society Kernel allows a Cultivator to start their own virtual society in SEED, giving them access to a part of Virtual Land on an Island of the Elio Archipelago. A Cultivator who starts a Virtual Society is referred to as a Society Leader. A Society Kernel includes a number Gift Codes which allow the Society Leader to provide Gifted Seedlings to invite a number of fellow Cultivators into the Virtual Society, to co-create the Virtual Society and to coordinate within a chosen or evolving governance system. A Society Kernel allows the Society Leader to (i) Establish a Virtual Society on an available part of Virtual Land; (ii) Share a number of Gift Codes for Gifted Seedlings with other Cultivators (Gift Codes become activated upon purchase of the Society Kernel); (iv) Set the initial coordination mechanism for the Virtual Society from a menu of options; (v) Decide whether the Virtual Society will be locked or open; (vi) name the Virtual Society. A Society Kernel does not imply any guarantee of persistence for the Virtual Society. Virtual Societies are provided subject to Publisher’s discretion and may be subject to changes, rebalancing or resets of SEED. Virtual Societies must adhere to the Community Standards. Violations of the Community Standards in a Virtual Society may lead to the ban or removal of the entire Society. Publisher may hold Society Leaders responsible to uphold and enforce Community Standards in their Virtual Society. |
